2. Services Provided

The Company provides freight brokerage, customs support, ferry booking services, and digital informational products related to logistics and international transport. Detailed information and specific terms for each service are presented on the Website or at checkout.

3. Eligibility

• The Website and services are available to natural persons and legal entities with capacity to contract under Romanian and EU law.
• By placing an order, you confirm you are at least 18 years old and/or have authority to represent your company.

4. Prices and Payments

• Prices are displayed in EUR or RON and include/exclude VAT as specified on the Website or in the invoice sent to the customer.
• Payments are processed exclusively through Netopia (Visa, Mastercard, online banking). Card data is entered on Netopia’s secure pages.
• The Company does not store or process card details. For transaction processing, necessary data is shared with Netopia in accordance with their privacy policy.
• Invoices may be issued electronically and sent by email to the customer, including final prices and applicable VAT.
• In some cases, the invoice may be issued in EUR, while the customer pays in RON. Currency conversion is performed automatically by the payment processor at the applicable daily exchange rate.
• By choosing online payment, you consent to the processing of your personal data in accordance with the privacy policy of the payment provider Netopia.

5. Contracts and Orders

1. Submitting an order constitutes an offer to purchase services under these Terms.
2. The contract is concluded when the Company confirms the order by email or within the user’s account.
3. The customer will receive an invoice by email containing the final price, service description, and payment instructions. This invoice serves as the commercial basis for payment and contractual performance.
4. The Company may refuse or cancel an order if information is incomplete/incorrect, payment is not authorized, services are unavailable, or fraudulent/abusive behavior is suspected. Any amounts paid will be refunded where applicable.

6. Cancellations and Refunds

• Cancellation/refund requests must be sent to info@aifreight.ro including order number and justification.
• Where the customer is a consumer, refunds are handled in line with Directive 2011/83/EU and Romanian law. The right of withdrawal does not apply after full performance of services with prior consent, and does not apply to digital content once access is granted or to services already delivered (e.g., completed consultancy, submitted customs declarations, confirmed ferry bookings subject to carrier rules).
• If a refund is approved, it will be processed within 14 days to the original payment method via Netopia.
• Third-party carrier terms (e.g., ferry operators) may impose additional restrictions or fees; these prevail where applicable.

7. Liability

• The Company is not liable for delays, interruptions, or losses caused by force majeure (including but not limited to natural disasters, strikes, outages, border closures, customs delays) or by inaccurate/incomplete data provided by the customer.
• To the maximum extent permitted by law, the Company’s aggregate liability is limited to the value paid for the respective service.

8. Intellectual Property

All materials on the Website (logos, text, designs, documents, and digital materials) are owned by or licensed to AI FREIGHT S.R.L. and are protected by applicable IP laws. Any unauthorized use, reproduction, or distribution is prohibited.

9. Data Protection and Privacy

• The Company processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and national legislation, as detailed in the Website’s Privacy Policy.
• Data is processed for order execution, billing, communication, fraud prevention, and legal obligations. For payments, transaction data is transmitted to Netopia for processing.
• Users have GDPR rights of access, rectification, erasure, restriction, portability, and objection, exercisable via info@aifreight.ro.

10. Applicable Law and Jurisdiction

These Terms are governed by the laws of Romania and applicable EU legislation. Any disputes shall be brought before the competent Romanian courts.
